Rabat - His Majesty King Mohammed VI inaugurated, Wednesday in Rabat, the new headquarters of the Constitutional Council which, in accordance with Article 177 of the 2011 constitution, will continue to exercise its powers until the setting up of the Constitutional Court.

Reflecting the strong commitment of Morocco to promote the rule of law, the Constitutional Court decides, under Article 132 of the Constitution on the regularity of the election of members of Parliament and of referendums. Similarly, the organic laws before their promulgation and the regulations of the House of Representatives and the House of Advisers, before their implementation, shall be submitted to the Constitutional Court to rule on their conformity with the Constitution.

For the same purpose, international laws and commitments may be referred to the Constitutional Court before their enactment or ratification by the Sovereign, the head of government, the speaker of the House of Representatives, the speaker of the House of Advisers, or by the fifth of the members of the House of Representatives or forty members of the House of Advisers.

The Constitutional Court can also hear an objection of unconstitutionality raised during a trial, when one of the parties claim that the law on which the case outcome depends, infringes the rights and freedoms guaranteed by the Constitution.

The decisions of the Constitutional Court are not subject to appeal. They are binding on public authorities and on all administrative and judicial authorities.

Under Article 130 of the Constitution, the Constitutional Court is composed of twelve members appointed for a term of nine years. Six members are appointed by the King, one member is proposed by the secretary general of the Higher Council of Ulema, and six members are elected by the House of Representatives and the House of Advisers (3 members each) from the list of candidates nominated by the Bureau of the House.

President of the Constitutional Court is appointed by the King, among the members of the Court.

On the occasion of the inauguration of the new headquarters of the Constitutional Council, the Council's president, Mohamed Achargui presented to the Sovereign a book in Arabic entitled "Glossary of constitutional terms."
